Terms of Service

1. The agreement
These Terms govern your access to and use of DeskBoot ("Service"), operated by DeskBoot ("we", "us"). By signing up or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 18 years old (or the age of legal majority where you live), have legal capacity to enter contracts, and not be barred from using cloud services under any applicable sanctions or laws.
3. Your account
You sign in via Google OAuth — protect that Google account. You're responsible for activity that happens under your DeskBoot account, including any sessions you launch, data they store, and charges they incur. Phone verification is required for the Service to function.
4. The Service
DeskBoot provisions virtual machines on Amazon Web Services on your behalf and provides a dashboard to manage them. We grant you a non-exclusive, non-transferable, revocable license to use the Service for your own internal or business purposes, subject to these Terms.
5. Payments & billing
The Service is prepaid. You add funds ("Balance") via Paystack-supported methods (card, M-Pesa, bank transfer, etc.). Running sessions deduct from Balance per second at the published rate. Stopped sessions deduct a smaller storage rate. Elastic IPs deduct a monthly fee from Balance.
Auto top-up:if enabled (default ON), when your Balance drops below your threshold we charge your saved card the configured amount. Failed top-ups don't stop the meter — sessions will auto-stop at $0 Balance.
Refunds: unused Balance is refundable on account closure subject to a $5 processing minimum. Charges already consumed (compute, storage, EIP fees) are non-refundable. Welcome credit ($5) is non-refundable and non-transferable.
Currency & FX: Balance is denominated in USD. Paystack charges may be in your local currency at the rate we publish; FX differences are not refunded.
6. Acceptable use
You agree to comply with our Acceptable Use Policy. Violations may result in immediate suspension or termination of your account without refund.
7. Your content & data
You own whatever you store inside your sessions and on snapshots. We don't inspect session contents except as required to (a) provide the Service, (b) comply with law, or (c) investigate AUP violations. Your session disks are encrypted at rest.
Data preservation:Stopped sessions preserve disks indefinitely (subject to storage charges). Terminated sessions delete everything — there's no undo and no way to recover.
8. Service availability
We aim for high availability but don't commit to a specific SLA at this time. The Service depends on AWS and other third parties; outages there may affect you. See /status for current health.
9. Termination
You may close your account at any time from the dashboard. We may suspend or terminate your account for AUP violations, non-payment, fraud, or as required by law. On termination, your active sessions are stopped, snapshots and disks deleted after a reasonable grace period, and unused refundable balance returned where applicable.
10. Disclaimers
The Service is provided "as is" without warranty of any kind, express or implied. We don't warrant uninterrupted service, error-free operation, or that the Service will meet your specific needs.
11. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, incidental, consequential, special, or punitive damages.
12. Indemnification
You agree to indemnify us against claims arising from your use of the Service, your content, or your violation of these Terms or applicable law.
13. Changes
We may update these Terms from time to time. Material changes will be announced by email and a dashboard notice. Continued use after the effective date constitutes acceptance.
14. Governing law & disputes
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, except where applicable consumer law requires otherwise.
